Terms of use
These terms govern your access to and use of Treadwell Terminal (the “Platform”), including the curated compilation of public property data and the associated endpoint catalogue. By using the Platform you agree to be bound by these terms.
1. Purpose and informational nature
Treadwell Terminal aggregates publicly available property data from government open data sources across Canadian provinces. The Platform is provided for informational and research purposes only. It is not a substitute for an official municipal record, a land title search, a licensed survey, a professional appraisal, or legal or financial advice.
Property boundaries displayed are graphical representations derived from public data. They are not certified plans, legal descriptions, or surveys, and must not be relied upon for boundary disputes, construction, conveyancing, or any purpose requiring precise legal boundaries. Consult a licensed land surveyor for authoritative boundary determination.
Assessment values, sales records, zoning designations, building permits, and all other property information may contain errors, omissions, or outdated entries.
2. Warranties and liability
All data and functionality are provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of accuracy, completeness, reliability, merchantability, or fitness for a particular purpose.
Treadwell Real Estate Data Providers, its officers, directors, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of, or inability to use, the Platform or any data presented through it. You assume all risk associated with your use, interpretation, and reliance on the data.
Nothing displayed on the Platform constitutes legal, financial, investment, tax, or professional real estate advice, and nothing should be construed as an official endorsement by any government body, municipality, or upstream data provider.
3. Intellectual property in the compilation
The individual data points exposed through the Platform originate with public authorities and are used under the terms of each authority’s published licence (see Attribution). The compilation of those data sources — including the curated endpoint catalogue, the selection, arrangement, and integration of endpoints, fields, jurisdictional metadata, and accompanying schema work — is the original intellectual property of Treadwell Real Estate Data Providers.
Under section 2 of the Copyright Act (Canada), a compilation is itself a protected work even where the underlying data are not. Treadwell’s endpoint compilation is a compilation in this sense and is protected accordingly.
4. Use restrictions
You may not, directly or indirectly:
- Scrape, harvest, mirror, bulk-extract, or systematically download the curated compilation, the endpoint catalogue, or any derivative compilation thereof, whether by automated or manual means.
- Use the Platform or any data extracted from it to populate, train, fine-tune, or seed any competing product, database, dataset, or machine-learning model.
- Circumvent, attempt to circumvent, or assist any other person to circumvent the terms-acceptance gate, the rate-limiting controls, or any other technological measure that controls access to the protected compilation.
- Reverse-engineer the Platform’s integration logic for the purpose of reproducing the compilation.
- Republish, redistribute, sublicense, or sell the compilation or any meaningful portion of it.
You retain the ability to inspect the Platform’s public HTML and front-end code for personal reference, education, security research, or fair-dealing purposes recognised under Canadian copyright law. The restrictions in this section target extraction of the compilation, not casual inspection.
5. Archived and cached snapshots
Continued use of any archived snapshot of the Platform, or of any data preserved within an archived snapshot, constitutes your agreement to the current version of these terms. The use restrictions in section 4 apply equally to archived copies of the Platform.
6. Upstream licences
The Platform aggregates content under licences including, without limitation:
- Service New Brunswick — GeoNB Open Data Licence
- Province of Nova Scotia — Nova Scotia Open Data Licence / Unrestricted Data Use License
- Province of British Columbia — Open Government Licence (British Columbia); ParcelMap BC Public Use Licence (LTSA)
- Gouvernement du Québec — Conditions d’utilisation du Cadastre du Québec; Données Québec dataset-level licences
- Province of Ontario — Open Government Licence (Ontario)
- Province of Manitoba, Alberta, Saskatchewan, Prince Edward Island, Newfoundland and Labrador — each province’s open data licence
- Natural Resources Canada — Open Government Licence (Canada)
- OpenStreetMap contributors — Open Database Licence (ODbL)
- Individual municipal open-data licences as published by each issuing municipality
Use of the Platform constitutes your acceptance of all applicable upstream data licence terms. Per-layer attribution is shown alongside each layer in the terminal and summarised on the attribution page.
7. Enforcement and remedies
Treadwell Real Estate Data Providers reserves the right to suspend or terminate any user’s access to the Platform for breach of these terms, and to pursue all remedies available at law or in equity, including injunctive relief, damages, costs, and account of profits, for unauthorised extraction or use of the compilation.
8. Changes to these terms
Treadwell may update these terms from time to time. Material changes will be reflected by an updated “Terms version” identifier at the top of this page. Continued use of the Platform after a change constitutes acceptance of the updated terms. The most recent version is always the version published at treadwellterminal.com/terms.
